1. Scope of Service
SpEd Bot ("the Service") is designed exclusively for school-based Speech-Language Pathologists (SLPs) and special education professionals working with student educational records governed by the Family Educational Rights and Privacy Act (FERPA).
Important: FERPA Scope Only
This Service is intended for use with educational records in school settings (K-12, school districts, educational agencies). It is NOT designed or intended for use with Protected Health Information (PHI) from HIPAA-covered entities such as:
- Hospitals and medical centers
- Private healthcare clinics
- Early intervention programs billed through Medicaid
- Skilled nursing facilities
- Any healthcare provider or health plan covered by HIPAA
By using this Service, you represent and warrant that you are using it only for FERPA-governed educational records and NOT for PHI subject to HIPAA.
2. Acceptable Use
You agree to use the Service only for:
- Documenting therapy sessions for students in educational settings
- Tracking progress toward IEP (Individualized Education Program) goals
- Generating progress reports for educational purposes
- AI-assisted documentation within the FERPA framework
You agree NOT to use the Service for:
- Processing Protected Health Information (PHI) from healthcare settings
- Any use requiring HIPAA compliance or a Business Associate Agreement (BAA)
- Medical billing, insurance claims, or healthcare-related documentation
- Any illegal purpose or in violation of applicable laws
3. Data Privacy & Security
We implement security measures to protect student educational records:
- Encryption: All data is encrypted in transit (TLS 1.3) and at rest (AES-256)
- Access Control: Row-level security ensures you only access your own data
- AI Processing: Student last names are never sent to AI services; only first names when necessary
- No AI Training: Your data is not used to train AI models
- Data Ownership: You retain ownership of all data you enter

4. FERPA Compliance
SpEd Bot is designed to support your FERPA compliance obligations as an educational professional. We act as a "school official" with a "legitimate educational interest" under FERPA when you use the Service to manage student records.
You are responsible for:
- Ensuring your use of the Service complies with your school/district policies
- Obtaining any necessary approvals from your institution
- Using appropriate security practices (strong passwords, secure devices)
- Not sharing account credentials with unauthorized individuals
5. HIPAA Disclaimer
Healthcare Users: Do Not Use This Service
SpEd Bot does NOT have a Business Associate Agreement (BAA) with our AI provider and is NOT HIPAA compliant. If you work in a healthcare setting covered by HIPAA, you must not use this Service to process patient information.
We do not offer a BAA and cannot accept responsibility for PHI. Healthcare SLPs should use HIPAA-compliant documentation tools that have appropriate Business Associate Agreements in place.
6. AI-Generated Content
The Service uses artificial intelligence to assist with documentation:
- AI-generated content is provided as a draft for your review
- You are responsible for reviewing and approving all AI-generated reports
- AI may make errors; always verify accuracy before distribution
- You maintain professional responsibility for all documentation you submit
7. Account & Termination
You may delete your account at any time. Upon deletion, we will remove your personal data and student records from our systems within 30 days, except as required by law.
We may terminate or suspend your access if you violate these Terms, particularly if you use the Service for HIPAA-covered activities.
8. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Errors or inaccuracies in AI-generated content
- Data loss or security breaches beyond our reasonable control
- Any use of the Service for HIPAA-covered activities
- Compliance failures resulting from your misuse of the Service
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
